TERMS OF REFERENCE
- to monitor the transposition of the public procurement Directive into national legislation and administrative practices
- to monitor EU initiatives with regard to public procurement and develop the industry’s policies
- to prepare arguments for, and promote quality based selection
- to fight unfair competition from in-house / public bodies

Lowest-price based selection: policy statement (in progress)

Exchange of information: conflict of interest (national practices), registration and pre-qualification, dispute adjudication

comprehensive EC evaluation of EU procurement legislation and policies: to discuss objectives of EU law and impact of EU policies on the industry, contribution of industry to EU goals (2020 strategy, quality outcomes etc.) and to develop EFCA proposals to enhance best value and flexibility.
The EFCA recommendations will be finalised for discussion with DG MARKT by September-October 2010
